Koenig Jacobsen Obtains Defense Verdict in Architectural Errors & Omissions Case


Koenig Jacobsen obtained a defense verdict on behalf of a prominent architectural firm after a four-week jury trial following a one-week bench trial in the San Diego Superior Court.  The plaintiff in this matter was the purchaser of retail space in a mixed-used building in downtown San Diego while the cross-complainant was the developer of the property.  The plaintiff alleged that it did not receive the proper amount of square footage as promised by the developer and sought damages in excess of $1,000,000.  The developer claimed that it relied upon the architect’s expertise to provide sufficient square footage.  After hearing all the evidence, including testimony of numerous witnesses and experts, the jury returned a defense verdict in favor of the architect.
