The plaintiff in this matter was an owner/developer of a 14-acre commercial parcel located in the Lake Elsinore area. Plaintiff alleged three separate causes of action for breach of contract, professional negligence and negligent misrepresentation, seeking damages in excess of $1,000,000.00. After hearing all the evidence, including testimony of numerous witnesses and experts, the jury returned a defense verdict on all three causes of action finding the plaintiff should take nothing by virtue of its complaint. In addition, Koenig Jacobsen early on served a C.C.P. section 998 offer on plaintiff for a nominal amount and, since our client prevailed on all causes of action, we have filed a Memorandum of Costs seeking significant “court costs and expert costs” from plaintiff.
